Class A covers accommodation facilities including hotels, villas, homestays, lodges, tented camps, spa resorts, eco-lodges, tree houses, and apartments.

Class B includes restaurants and food and beverage service establishments operating within the tourism sector.

Class C encompasses tour operators, safari companies, tourist service vehicle hire businesses, travel agencies, local air charter services, water sports operators, balloon safari companies, and boat excursion providers.

Class D covers nature-based tourism facilities such as nature parks, nature reserves, game ranches, and similar enterprises.

Class E includes individual tourism professionals and small-scale operators like local traditional boat operators, curio vendors, beach operators, and tour guides.

Class F covers entertainment facilities serving the tourism sector.

Additional classes exist for other specialized tourism services and facilities.

General Requirements for TRA Licensing

While specific requirements vary depending on the license class, most TRA license applications require certain fundamental documents:

Business Registration: Certificate of business registration for sole proprietors, or certificate of incorporation with CR 12 forms for limited companies.

Identification: National ID copies for Kenyans, passports for foreigners. Non-Kenyan directors need entry or work permits.

Tax Compliance: KRA PIN certificate demonstrating tax registration.

Premises: Title deed or lease agreement for business premises.

Professional Qualifications: Valid certificates from recognized institutions, especially for tour guides.

Insurance: Appropriate policies for vehicles, vessels, or aircraft.

Vehicle Documentation: Logbook copies or hire contracts from licensed companies.

Health Certificates: Required for food service and accommodation facilities.

Foreign Investment: Businesses must show capital base of at least USD 100,000.

Association Letters: Tour guides and beach operators need recommendations from recognized professional associations.

Application Process

TRA has modernized licensing through the Tourism Integrated Management System (TRIMS) at trims.tourismauthority.go.ke. Applicants can register businesses, complete forms, upload documents, and make payments online.

New applicants pay an application fee of Ksh 1,000. License fees vary based on business category, size, and revenue as outlined in Legal Notice No. 128 of 2014. Restaurant fees, for example, are tiered from businesses earning under Ksh 5 million to those exceeding Ksh 25 million.

License Renewal and Compliance

TRA licenses must be renewed annually. Section 19(1) of the Tourism Act requires license renewal three months before expiry. Late renewal attracts a penalty of 10% of the applicable license fee for every month of delay. This strict enforcement ensures businesses maintain continuous compliance with regulations.

Licensed tourism enterprises must prominently display their licenses within their premises. TRA officers conduct regular inspections to verify compliance with licensing conditions and quality standards. Non-compliance can result in penalties, including fines of up to Ksh 100,000 or even imprisonment in severe cases.
